New provincial rules to curb predatory towing

The Government of Alberta has introduced new rules to prevent predatory towing practices and improve protections for drivers at collision scenes. 

Until now, no province-wide penalties existed to deter unscrupulous tow truck operators from towing people’s vehicles without consent, withholding key information from vehicle owners, or exploiting vulnerable individuals who were involved in vehicle accidents. 

The new measures introduce clear and consistent standards across Alberta to prevent this kind of misconduct. Key changes include: 

  • A 200-metre exclusion zone around collision scenes. Tow truck operators are prohibited from soliciting their services unless invited by authorized personnel. 
  • A $1,000 fine – the maximum currently allowable under the Traffic Safety Act for any tow truck operator or individual who violates the exclusion zone rule. 
  • Clear rules to ensure drivers are informed of their rights and can request or refuse towing services without pressure. 

These updates are intended to empower drivers, reduce confusion at stressful moments, and help curb rising insurance costs driven by excessive towing fees. They also align with efforts by municipalities like Calgary and Edmonton that have already taken steps to address predatory towing practices. 

The provincial government intends to work with municipalities and industry partners to identify further improvements that protect consumers and promote integrity when it comes to the towing industry. Alberta Municipalities is involved in these engagements and will continue to update members on this issue.
